Child Enticement/Child Pornography Trial Finally Starting For Hot Springs Man

      The trial of a Hot Springs man arrested in a child enticement-child pornography sting operation is finally set to begin Tuesday morning before a jury in federal court in Rapid City. 

     56-year old Brian Spitzer was charged Jan 12 of last year and set for trial in March, but the trial was delayed 4 times – to June, September, December, and finally this month.

      Spitzer is charged with Attempted Enticement of a Minor, Attempted Enticement of a Minor Using the Internet, and Attempted Receipt of Child Pornography. He has been free on bond since his first court appearance just under a year ago.

     Court documents show Spitzer was arrested after being online with what he thought was a 14-year old girl, but turned out to be an undercover law enforcement agent.

      The investigation involved the federal Dept of Homeland Security, South Dakota Division of Criminal Investigation, Rapid City Police Dept, and the Pennington County Sheriff’s Office. Assistant US Attorney Sarah Collins is the prosecutor.

      If convicted, Spitzer faces from a mandatory 15 years minimum to life in prison plus a $250,000 fine.

    • My daughter was in a fashion show a couple months ago where he sat front row the whole time. I’ve heard talk about him being at the boys n girls club while all this is going on. Sad that he’s been around so many minors.
