Marijuana Legislation To Face SD Lawmakers In Session Starting 1/11/22

      Marijuana will be on the table again later this month when the South Dakota legislature begins its 2022 session.

      So far, more than two dozen of 38 posted proposed bills for the session deal with medical and recreational marijuana. 

       It’s the second session for legislators since South Dakota voters in 2020 approved two marijuana initiatives – one for medical pot and one legalizing both medicinal and recreational use. 

       The combined measure was challenged in court by Gov. Kristi Noem and was ultimately struck down by the state Supreme Court as unconstitutional because it violated a constitutional provision limiting amendments to one subjec.

       Legislators are expected to consider revisions to the existing medical cannabis law, which went into effect last year, and take up Senate Bill 3 – which legalizes recreational possession of one ounce or less of marijuana by a person 21 or older.
