Nebraska Record $26.1-M Jury Award In Medical Malpractice Case

      A jury in Omaha has awarded a Nebraska-record $26.1-million dollars to a Sarpy County family in a medical malpractice case, but the amount could be slashed by the state’s $2.25-million cap on such awards.

     The family of 5-year old Vivianne Marousek sued Children’s Hospital and Medical Center in Omaha after she was sent home following a fall, then suffered seizures that left her permanently disabled.

      The jury found that the hospital and one of its doctors improperly discharged the girl in 2017 after failing to diagnose that she’d suffered brain trauma in an accidental fall.

      The jury awarded $21.5-million to Vivianne for damages and her lifetime care and another $4.6-million to her parents.
