Prosecutor: Bar Owner Waited To “Ambush” People Breaking Into Businesses

Jake Gardner

A special prosecutor says the white Omaha bar owner who killed himself after being charged with manslaughter for fatally shooting a Black man during Black Lives Matter protests in May had been waiting to “ambush” people who were breaking into businesses.

The Douglas County Attorney had ruled that Jake Gardner’s shooting of 22-year old James Scurlock had been self-defense, but a grand jury was called and last week indicted Gardner on 4 felony counts including manslaughter. He committed suicide Sunday in Oregon.

Special Prosecutor Frederick Franklin on Wednesday detailed more of the evidence against Gardner including text messages and videos of the encounter that Franklin said countered Gardner’s claims of self-defense
