Judge Travis O’Gorman set a jury trial and sentenced several other defendants Tuesday in Dawes County District Court.
Shawne Russell will have a jury trial Oct. 18-20 for an alleged October 2021 assault and robbery. Russell is charged with first degree assault, robbery, two counts possession of a firearm by a prohibited person, two counts of possessing or receiving a stolen firearm, all felonies, and unauthorized use of a propelled vehicle, a misdemeanor. His alleged victim was found nearly unconscious with multiple lacerations and head and face swelling, according to court records.
Oliver Fox, who entered a plea deal in May to delivery of a controlled substance, four counts of possession with intent to deliver cocaine and fentanyl and possession of drug paraphernalia was ordered to serve to up to 90 days with the Nebraska Department of Corrections for further evaluation. O’Gorman’s order requires evaluation into his previous criminal and social backgrounds, mental, physical and emotional health and any rehabilitation programs that may be useful. Following his evaluation or at the end of 90 days, Fox will be returned to the Dawes County Jail for final sentencing.
Warfield High Hawk was sentenced to 90 days on misdemeanor counts of third-degree assault, assault in a threatening manner and resisting arrest. Originally charged with two felonies and one misdemeanor related to an incident last September, High Hawk will serve the sentences concurrently with credit for seven days.
Devin Julius was sentenced to 24 months in prison on two separate counts, assault by strangulation or suffocation and terroristic threats. He will receive credit for two days of time served and must be on post-release supervision for nine months. His two sentences will be served concurrently.
Hunter Welling was sentenced to six months for possession of a controlled substance with nine days credit. He will also serve one year to 18 months for attempt of a Class II felony, concurrently with is other term.
