A 34-year-old Oregon man arrested in Chadron in March after he was found sleeping or passed out in his car downtown with more than 10 pounds of marijuana in Chadron has been sentenced to about a year in jail.
34-year old Allen Powely of Rogue River took a plea deal and pled guilty in September to distribution of a controlled substance. This week he was sentenced to 364 days with 224 days of credit for time already served.
Powley was originally charged with possession of over a pound of marijuana, possession of marijuana with intent to distribute, possession of heroin, possession of Oxycodone, possession of methamphetamine, and possession of drug paraphernalia.
Chadron Police Sgt Chelsey Stolley found Powley in his car in an alley near a business in the 200 block of Main Street while conducting routine overnight business checks.
Sgt Stolley said she could see Powley asleep or passed out in the driver’s seat but with his window open slightly allowing her to smell the odor of fresh marijuana from inside.
     She called for backup and the two officers woke up Powley and searched his rental car, where they found over 10 pounds of marijuana.
They also found THC wax and hashish, about a gram of suspected heroin, and residual amounts of methamphetamine as well as digital scales and small plastic bags.Â
So all those drugs and he gets less than a year in jail? Seriously, why have drug laws to begin with if it is always a slap on the wrist?
Well, he’s got free room & board through a cold NE winter. Hmmmm?
