DOJ Joins Effort to Repeal Nebraska In-state Tuition for Immigrants

The Department of Justice is joining in with Nebraska to pull back from a state law that allows some undocumented immigrants who grew up and graduated in the state to pay in-state tuition at public colleges and universities.

The federal government filed a complaint against Nebraska last week joining Attorney General Mike Hilgers in filing a proposed consent decree to permanently enjoin the law.

The DOJ press release says the decree which needs to be approved by the court would resolve the department’s claim that the Nebraska law unconstitutionally discriminates against U.S. citizens in favor of illegal immigrants.

Some critics of the rollback fear it would hurt enrollment at the state’s colleges and universities but Nebraska governor Jim Pillen celebrated the state, federal partnership with the Trump administration, thanking the DOJ and Hilgers for delivering what he considers a long overdue correction to the state law.
