Spitzer Trial Postponed For 5th Time

     The federal court trial of a hot springs man arrested in a child enticement-child pornography sting operation has bee postponed for a 5th time.

    56-year old Brian Spitzer was scheduled for trial Jan 4th, but its now been pushed back to July 26.

Spitzer was charged on Jan 12, 2021, and set for trial that March but it was postponed until June, then September, December, and finally January.

     Spritzer is charged with Attempted Enticement of a Minor, Attempte Entricement of a Minor Using the Internet, and Attempted Receipt of Child Pornography. He’s been free on bond since his first court appearance just over a year ago.

     Court documents show Spitzer was arrested of being online with what he thought was a 14-year old girl but turned out to be an undercover law enforcement agent.

     The investigation involved the federal Dept of Homeland Security, South Dakota Division of Criminal Investigation, Rapid City Police Dpet, and the Pennington County Sheriff’s Office. Assistant U-S Attorney Sarah Collins is the prosecutor.

      If convicted, Spitzer would face at least a minimum of 15 years in prison and up to life plus up to a $250,000 fine.
